Physical therapy includes:
-Design, fabrication, revision, education and instruction in the use of various AD's including braces, splints, ambulatory, locomotion devices, w/c's, prosthetics and orthotics
-Administration of topical drugs that have been prescribed by a licensed health professional authorized to prescribe drugs
-Establishment and modification of PT programs, treatment planning, patient education and instruction, and consultative services
-Physiotherapy

Physical measures include:
Massage, heat, cold, air, light, water, electricity, sound, and performance of test of neuromuscular function
Physical therapy DOES NOT include:
Medical diagnosis of patient's disability, the use of Roentgen rays or radium for diagnostic or therapeutic purposes, or use of electricity for cauterization or other surgical purposes.
Physical Therapist
A person who practices or provides patient education and instruction in physical therapy and includes a physiotherapist
Individual who performs initial examination unless that PT has transferred the responsibility for the management of the patient's care to another PT and that PT agrees to the transfer
Physical Therapist Assistant
A person who assists in the provision of physical therapy treatments, including the provision of patient education and instruction, under the supervision of a physical therapist
Supervision
Availability and responsibility of the supervisor for direction of the actions of the person supervised
Duties of PT section
-License persons desiring to practice PT or as PTA's in this state
-Conduct investigation, inquiry, or hearings. Any findings confirmed or approved by the section
-Keep record of proceedings
-Keep register of applicants
-Maintain a register of every PT and PTA in this state; including last known place of business, last known residence, date and number of the license
-Deposit all fees collected
-Provide applicant with section address, dates of upcoming meetings and list of section member names upon receipt of an application.

-Min of 120 academic semester credits or equivalent, including courses in biological and other physical sciences

What is the fee for application/license?
Not more than $125
How soon should the section approve application to sit for examination?
No later than 120 days after receiving the app.

The board can:
-Request documents relevant to the section's evaluation of the application
-Notify applicant in writing of intent to deny a license and applicant's right to request a hearing to appeal decision
If section fails to comply:
Section shall refund 1/2 of the application fee to applicant

Criminal records check
OTPTAT board shall not grant a license to an applicant for initial license unless applicant complies with sections of the revised code and the board decides that the results of the criminal records check do not make the applicant ineligible for a license.

Grounds for disciplinary action:
-Habitual indulgence in the use of controlled substances, habit forming drugs, or alcohol that affects professional competency
-Conviction of a felony or crime involving moral turpitude
-Obtaining a license by fraud, deception, making false, fraudulent, deceptive or misleading statements
-Applicant/licensee is incompetent for the purpose of holding the license and has not been restored to legal capacity
-Violation of code of ethics
-Failure of one or both exams
-Permitting the use of one's name/license by person, group or corporation when one permitting the use is not directing the treatment
-Failure to maintain minimal standards of practice in administration or handling of drugs, failure to employ acceptable scientific methods in the selection of drugs or other modalities
-Willful betrayal of professional confidence
-Making false, fraudulent, deceptive, or misleading statements
-Departure from or failure to conform to minimal standards of care
-Obtaining or attempting to obtain money or anything of value by fraudulent misrepresentations
-Failure to renew a license
-Engaging in the division of fees for referral of patients
-Inability to practice according to acceptable standards of care bc of mental illness or physical illness
-Revocation, suspension, restriction or termination of clinical privileges by US DoD
-Termination or suspension from participation in medicare/medicaid program
-Failure of a PT to maintain supervision of a student, PTA, unlicensed personnel, other assistant personnel, or a license applicant
-Failure to complete CEU's
-Conviction of a misedemeanor when act occurs during practice of PT
-Failure to cooperate with an investigation conducted by the PT section
-Engaging with a patient other than the spouse of the PT or PTA in sexual contact or verbal behavior that is sexually demeaning to the patient.
-Failure to notify the board of change in name/address within 30 days
-Waiving payment of all or any part of a deductible or copayment that a patient is required to pay.
Violations: No person shall:
-Employ fraud or deception in applying for or securing a license to practice PT or be a PTA
-imply or claim to public by words or actions to be able to practice PT or provide PT services
-Fail to display current license in a conspicuous location in the place of work
-Nothing shall interfere with the performance/duties of any PT/PTA in the active military
-Nothing shall prevent or restrict a person from pursuing a course of study leading to a degree in PT when person is clearly designated as a student
Words/Letters that cannot be used unless person has valid license
Physical therapist, physical therapy, physical therapy services, physiotherapist, physiotherapy, physiotherapy services, licensed physical therapist, PT, PhT, PTT, RPT, LPT, MPT, DPT, MSPT, PTA, physical therapy assistant, physical therapist assistant, physical therapy technician, licensed physical therapist assistant, LPTA, RPTA
If a person is contracted/employed with an athletic team can provide PT to any of the following while traveling to or from a sporting event in this state:
-A member of athletic team
-Member of the athletic team's coaching, communications, equipment, or sports medicine staff
-Member of a band or cheerleading squad
-Team's mascot
If a person is contracted/employed with an athletic team and traveling with the team, the person CANNOT:
-Provide PT at a healthcare facility
-Provide PT for more than 60 days in a calendar year
No person shall practice PT unless on prescription of, referral of a patient by a person who is licensed to:
-Practice medicine and surgery, chiropractic, dentistry, osteopathic medicine and surgery, podiatric medicine and surgery
-Practice as a PA
-Practice nursing as an advanced practice RN
To practice PT without a prescription of, or referral of a patient the person must:
-Hold a master's or doctorate degree from a professional PT program accredited by a national PT accreditation agency
-On or before Dec 31st 2004, person has completed at least 2 years of practical experience as a licensed PT.
Practice without a referral:
-PT evaluates and treats patient
-PT shall, with consent of patient, inform the relevant person of the eval not later than 5 business days after eval made
-If PT determines no progress has been made in 30 days immediately following eval, PT shall consult with relevant person
-UNLESS: eval, tx, or services are provided for fitness, wellness, or prevention purposes
-Pt previously diagnosed with chronic, neuromuscular, or development conditions and services are being provided for problems or Sx associated with condition
Tx without referral: PT is limited to these orthotics:
-Upper extremity adaptive equipment
-Finger splints
-Wrist splints
-Prefabricated elastic or fabric abd brace with or without metal or plastic reinforcing stays
-Nontherapeutic accommodative inlays
-Shoes that are not manufactured or modified for a particular individual
-Prefabricated foot care products
-Custom foot orthotics
